For the purposes of this Annex, ‘machinery’ means either ‘machinery’ or ‘safety component’ as defined in Article 1(2).

Para efeitos do presente anexo, o termo «máquina» designa quer a máquina, tal como define o no. 2 do artigo 1o. , quer o componente de segurança, tal como define esse mesmo número.

In deze bijlage wordt onder „machine” verstaan, ofwel de „machine” als omschreven in artikel 1, lid 2, ofwel de „veiligheidscomponent” als omschreven in datzelfde lid.

1. The body, its director and the staff responsible for carrying out the verification tests shall not be the designer, manufacturer, supplier or installer of machinery which they inspect, nor the authorised representative of any of these parties. They shall not become either involved directly or as authorised representatives in the design, construction, marketing or maintenance of the machinery. This does not preclude the possibility of exchanges of technical information between the manufacturer and the body.

O organismo, o seu director e o pessoal encarregado de executar as operações de verificação não podem ser o projectista, o fabricante, o fornecedor, o instalador das máquinas que verificam, nem o mandatário de uma dessas pessoas. Não podem intervir quer directamente quer como mandatários no projecto, fabrico, comercialização ou manutenção dessas máquinas. Isto não exclui a possibilidade de uma troca de informações técnicas entre o fabricante e o organismo.

De keuringsinstantie, de directeur daarvan en het met de keuring belaste personeel mogen niet de ontwerper, de fabrikant, de leverancier of de installateur zijn van de machines die zij keuren, noch de gemachtigde van een der genoemde personen. Zij mogen bij het ontwerpen, de bouw, het in de handel brengen of het onderhoud van deze machines noch rechtstreeks, noch als gemachtigden van de betrokken partijen optreden. Een eventuele uitwisseling van technische informatie tussen fabrikant en keuringsinstantie wordt door deze bepaling niet uitgesloten.

2. The body and its staff shall carry out the verification tests with the highest degree of professional integrity and technical competence and shall be free from all pressures and inducements, particularly financial, which might influence their judgement or the results of the inspection, especially from persons or groups of persons with an interest in the result of verifications.

O organismo e o pessoal encarregado do controlo devem executar as operações de verificação com a maior integridade profissional e a maior competência técnica, e devem estar livres de quaisquer pressões e incitamentos, nomeadamente de ordem financeira, que possam influenciar o seu julgamento ou os resultados da sua verificação, em especial dos provenientes de pessoas ou grupos de pessoas interessadas nos resultados das verificações.

2. De keuringsinstantie en het personeel dat met de keuringen is belast, dienen de keuring uit te voeren met de grootste mate van beroepsintegriteit en technische bekwaamheid; zij dienen vrij te zijn van elke pressie en beïnvloeding, met name van financiële aard, die hun beoordeling of de uitslagen van hun keuring kan beïnvloeden, inzonderheid van personen of groepen van personen die bij de resultaten van de keuring belang hebben.

3. The body shall have at its disposal the necessary staff and possess the necessary facilities to enable it to perform properly the administrative and technical tasks connected with verification; it shall also have access to the equipment required for special verification.

3. O organismo deve dispor de pessoal e possuir os meios necessários para cumprir de modo adequado as tarefas técnicas e administrativas ligadas à execução das verificações; deve igualmente ter acesso ao material necessário para as verificações excepcionais.

3. De keuringsinstantie dient over het nodige personeel en de nodige middelen te beschikken om de met de uitvoering van de keuringen verbonden technische en administratieve taken op passende wijze te vervullen; tevens dient de keuringsinstantie toegang te hebben tot het nodige materiaal voor bijzondere keuringen.

4. The staff responsible for inspection shall have:
— sound technical and professional training,
— satisfactory knowledge of the requirements of the tests they carry out and adequate experience of such tests,
— the ability to draw up the certificates, records and reports required to authenticate the performance
of the tests.

4. O pessoal encarregado dos controlos deve possuir:
— uma boa formação técnica e profissional,
— um conhecimento satisfatório das prescrições relativas às verificações que efectua e uma prática suficiente dessas verificações,
— a aptidão requerida para redigir os certificados e os relatórios que constituem a materialização dos controlos efectuados.

4. Het personeel dat met de keuringen is belast, dient:
— een goede technische en beroepsopleiding te hebben genoten;
— een behoorlijke kennis te bezitten van de voorschriften betreffende de keuringen die het verricht en voldoende ervaring met deze keuringen te hebben;
— de vereiste bekwaamheid te bezitten om op grond van de verrichte keuringen verklaringen, processen-verbaal en rapporten op te stellen.

5. The impartiality of inspection staff shall be guaranteed. Their remuneration shall not depend on the number of tests carried out or on the results of such tests.

5. Deve ser garantida a independência do pessoal encarregado do controlo. A remuneração de cada agente não deve ser em função do número de controlos que efectuar, nem dos resultados desses controlos.

5. De onafhankelijkheid van het personeel dat met de keuringen is belast, dient te zijn gewaarborgd. De bezoldiging van elke functionaris mag niet afhangen van het aantal keuringen dat hij verricht, noch van de uitslagen van deze keuringen.

6. The body shall take out liability insurance unless its liability is assumed by the State in accordance with national law, or the Member State itself is directly responsible for the tests.

6. O organismo deve fazer um seguro de responsabilidade civil, a não ser que essa responsabilidade seja coberta pelo Estado com base no direito interno ou que os controlos sejam efectuados directamente pelo Estado-membro.

6. De keuringsinstantie dient een verzekering tegen wettelijke aansprakelijkheid te sluiten, tenzij deze wettelijke aansprakelijkheid op basis van het nationale recht door de staat wordt gedekt of de keuringen rechtstreeks door de lidstaat worden verricht.

7. The staff of the body shall be bound to observe professional secrecy with regard to all information gained in carrying out its tasks (except vis-à-vis the competent administrative authorities of the State in which its activities are carried out) under this Directive or any provision of national law giving effect to it.

7. O pessoal do organismo está sujeito a sigilo profissional em relação a todas as informações que estiverem no exercício das suas funções (excepto em relação às autoridades administrativas competentes do Estado em que exerce as suas actividades) no âmbito da presente directiva ou de qualquer disposição de direito nacional que lhe dê efeito.

7. Het personeel van de keuringsinstantie is gebonden aan het beroepsgeheim ten aanzien van al hetgeen het bij de uitoefening van zijn taak in het kader van de richtlijn of van de bepalingen van intern recht die daaraan uitvoering geven, ter kennis is gekomen (behalve tegenover de terzake bevoegde overheidsinstanties van de staat waarin de keuringsinstantie haar werkzaamheden uitoefent).


The provisions of the new Directive (2006/42/EC) become applicable on 29th December 2009. Until that date, the provisions of the current Machinery Directive 98/37/EC continue to apply.
