1. The EC declaration of conformity is the procedure by which the manufacturer, or his authorised representative established in the Community declares that the machinery being placed on the market complies with all the essential health and safety requirements applying to it.
1. A declaração CE de conformidade é o procedimento mediante o qual o fabricante ou o seu mandatário estabelecido na Comunidade declare que a máquina colocada no mercado satisfaz todas as exigências essenciais de segurança e saúde que lhe dizem respeito.

2. Signature of the EC declaration of conformity authorises the manufacturer, or his authorised representative in the Community, to affix the CE marking to the machinery.

Before drawing up the EC declaration of conformity, the manufacturer, or his authorised representative in the Community, shall have ensured and be able to guarantee that the documentation listed below is and will remain available on his premises for any inspection purposes:
Antes de poder emitir a declaração CE de conformidade, o fabricante ou o seu mandatário estabelecido na Comunidade deve ter-se assegurado e poder garantir que a documentação a seguir definida está e continuará a estar disponível nas suas instalações para fins de controlo eventual.
Voordat de EG-verklaring van overeenstemming kan worden opgesteld, moet de fabrikant, of zijn in de Gemeenschap gevestigde gevolmachtigde, zich ervan hebben vergewist en kunnen garanderen dat de hieronder beschreven documenten te zijnen kantore beschikbaar blijven voor eventuele controles:
a) a technical construction file comprising:
— an overall drawing of the machinery together with drawings of the control circuits,
— full detailed drawings, accompanied by any calculation notes, test results, etc., required to check the conformity of the machinery with the essential health and safety requirements,
— a list of:
— the essential requirements of this Directive,
— standards, and
— other technical specifications, which were used when the machinery was designed,
— a description of methods adopted to eliminate hazards presented by the machinery,
— if he so desires, any technical report or certificate obtained from a competent body or laboratory (1),
— if he declares conformity with a harmonised standard which provides therefor, any technical report giving the results of tests carried out at his choice either by himself or by a competent body or laboratory (1),
— a copy of the instructions for the machinery;
a) Um dossier técnico de fabrico, constituído:
— pelo desenho de conjunto da máquina, bem como pelos desenhos dos circuitos de comando,
— pelos desenhos de pormenor e completos, eventualmente acompanhados de notas de cálculo, resultados de ensaios, etc., que permitam verificar a conformidade da máquina com as exigências essenciais de segurança e saúde,
— pela lista:
— das exigências essenciais da presente directiva,
— das normas e
— das outras especificações técnicas que foram utilizadas aquando da concepção da máquina,
— pela descrição das soluções adoptadas para prevenir os riscos apresentados pela máquina,
— se o desejar, por qualquer relatório técnico ou certificado obtido junto de um organismo ou laboratório (1),
— se declarar a conformidde com uma norma harmonizada que o preveja, por qualquer relatório técnico que forneça os resultados dos ensaios efectuados à sua escolha, quer por ele mesmo quer por um organismo ou laboratório(1) competente,
— por um exemplar do manual de instruções da máquina.
a) een technisch constructiedossier bestaande uit:
— het overzichtsplan van de machine, alsmede de tekeningen van de bedieningsschakelingen;
— gedetailleerde en volledige tekeningen, eventueel vergezeld van berekeningen, testresultaten enz., aan de hand waarvan kan worden nagegaan of de machine aan de fundamentele veiligheids- en gezondheidsvoorschriften voldoet;
— een lijst met:
— de fundamentele eisen van de richtlijn,
— de normen, en
— de overige technische specificaties, waarmee bij het ontwerp van de machine rekening is gehouden;
— een beschrijving van de preventieve voorzieningen met het oog op de aan de machine verbonden gevaren;
— desgewenst, ieder technisch verslag of ieder van een bevoegde instantie of een bevoegd
laboratorium (1) verkregen certificaat;
— indien hij de overeenstemming met een geharmoniseerde norm die dat voorschrijft, aangeeft, ieder technisch verslag waarin de uitkomsten van de proeven zijn opgenomen die, naar keuze, hetzij door hemzelf, hetzij door een bevoegde instantie of bevoegd laboratorium (1) zijn verricht;
— een exemplaar van de gebruiksaanwijzing van de machine;
b) for series manufacture, the internal measures that will be implemented to ensure that the machinery remains in conformity with the provisions of the Directive.
The manufacturer must carry out necessary research or tests on components, fittings or the completed machine to determine whether by its design or construction, the machine is capable of being erected and put into service safely.
Failure to present the documentation in response to a duly substantiated request by the competent national authorities may constitute sufficient grounds for doubting the presumption of conformity with the requirements of the Directive.
b) No caso de fabrico em série, as disposições internas que serão aplicadas para manter a conformidade das máquinas com as disposições da directiva.
O fabricante deverá efectuar as pesquisas e os ensaios necessários dos componentes e acessórios ou de toda a máquina a fim de determinar se esta, pelo modo como foi projectada e fabricada, pode ser montada e colocada em serviço com toda a segurança.
A não apresentação da documentação, após um pedido devidamente justificado das autoridades nacionais competentes, pode constituir razão suficiente para duvidar da presunção de conformidade com as disposições da directiva.

De fabrikant moet het nodige onderzoek verrichten en de nodige proeven uitvoeren met betrekking tot de onderdelen, de accessoires of de gehele machine om vast te stellen of deze qua ontwerp en bouw veilig kan worden gemonteerd en in gebruik genomen.
Het niet-overleggen van de documenten na een naar behoren met redenen omkleed verzoek van de bevoegde nationale autoriteiten, kan voldoende reden zijn om het vermoeden van overeenstemming met de bepalingen van de richtlijn in twijfel te trekken.

a) The documentation referred to in 3 above need not permanently exist in a material manner but it must be possible to assemble it and make it available within a period of time commensurate with its importance.
It does not have to include detailed plans or any other specific information as regards the sub-assemblies used for the manufacture of the machinery unless a knowledge of them is essential for verification of conformity with the basic safety requirements.
a) A documentação referida no ponto 3 pode não existir em permanência de modo material, mas deve poder ser reunida e posta à disposição num intervalo de tempo compatível com a sua importância.
Essa documentação não tem de incluir os desenhos de pormenor e outras informações precisas relativas aos subconjuntos utilizados para o fabrico das máquinas, a não ser que o seu conhecimento seja indispensável ou necessário para a verificação da conformidade com as exigências essenciais de segurança;
a) De in punt 3 bedoelde documenten behoeven niet permanent in materiële vorm voorhanden te zijn, maar moeten kunnen worden bijeengebracht en ter beschikking worden gesteld binnen een met het belang ervan verenigbare tijd.
Zij behoeven geen gedetailleerde tekeningen en andere uitvoerige inlichtingen met betrekking tot de bij de fabricage van de machines gebruikte onderdelen te bevatten, behalve indien kennis daarvan voor het controleren van de overeenstemming met de fundamentele veiligheidseisen onontbeerlijk of noodzakelijk is.
b) The documentation referred to in 3 above shall be retained and kept available for the competent national authorities for at least 10 years following the date of manufacture of the machinery or of the last unit produced, in the case of series manufacture.
b) A documentação referida no ponto 3 acima deve ser conservada e mantida à disposição das autoridades nacionais competentes pelo menos durante 10 anos a contar da data de fabrico da máquina ou do último exemplar da máquina, se se tratar de um fabrico de série;
b) De in punt 3 bedoelde documenten worden bewaard en ter beschikking gehouden van de bevoegde nationale instanties gedurende ten minste tien jaar na de datum van fabricage van de machine of na die van het laatste exemplaar van een in serie vervaardigde machine, met uitzondering van de gebruiksaanwijzing van de machine.
c) The documentation referred to in 3 above shall be drawn up in one of the official languages of the Communities, with the exception of the instructions for the machinery.

c) De in punt 3 bedoelde documenten moeten in één van de officiële talen van de Gemeenschap zijn gesteld, met uitzondering van de gebruiksaanwijzing van de machine.
The provisions of the new Directive (2006/42/EC) become applicable on 29th December 2009. Until that date, the provisions of the current Machinery Directive 98/37/EC continue to apply.
